SC MISLED CAG Reports RIL Drilling in ONGC & GSPC Blocks

Respected Sir,
Two recent CAG reports related to ONGC and GSPC had clearly
Established RIL is directly drilling in ONGC and GSPC Blocks therefore
RIL need be evicted from ONGC & GSPC discoveries.

Supreme Court of India must be told that RIL is Illegally Drilling in
ONGC and GSPC blocks and doesn't own Oil & Gas.

SC finds its 'independent' arbiter on RIL wishlist, withdraws him

New Delhi: Justice S S Nijjar of the Supreme Court on Wednesday
withdrew his two-day-old decision to name an Australian, exchief
justice of New South Wales James Spigelman, as the third arbitrator
for resolution of disputes between Reliance Industries Ltd and the
Centre over alleged breaches in production sharing contract relating
to KG basin gas exploration.

    On Monday, Justice Nijjar had in his 70-page judgment pointed out
that "although two lists have been duly supplied by the parties (RIL
and ministry of petroleum and natural gas), I am of the opinion, in
the peculiar facts and circumstances of this case, it would be
appropriate if an individual not named by any of the parties is
appointed as the third arbitrator".

    To back up his choice, Justice Nijjar had said, "I have discreetly
conducted a survey to find a suitable third arbitrator who is not a
national of any of the parties involved in the dispute."

    Spigelman was to act as the chairman of the arbitral tribunal. Two
former Chief Justices of India -- Justice S P Bharucha (nominated by
RIL) and Justice V N Khare (ministry's choice) -- would have worked as
arbitrators under the Australian in the tribunal.

    Making an urgent mention before Justice Nijjar on Wednesday, the
ministry's counsel and senior advocate Dushyant Dave pointed out that
Spigelman's name did figure in RIL's list containing names of possible
third arbitrators. Justice Nijjar confessed that, in fact, he had not
seen the lists provided by RIL and the ministry and had no hesitation
in withdrawing the Australian's name. He said he would soon name a
replacement.

    Dave also contended that it would be in the fitness of things to
allow Justice Bharucha and Justice Khare to hold discussions and
nominate the third arbitrator. But RIL's counsel Harish Salve,
objected to it saying the exercise had proved unsuccessful and pointed
out that Justice Nijjar's Monday judgment had already decided the
issue.
